Silver Link Repossession Software System - Houses - Cars - Property

The Silver Link property repossession software provides an automated County Court repossession procedure for cars, mortgage arrears, residential property rent arrears and the eviction of illegal occupants on land.  The mortgage arrears system issues various warning letters prior to the commencement of proceedings. After issue of a claim form, the legal procedure is tracked through to the possession hearing, the management of suspended and forthwith possession orders, and the process of eviction.

For mortgage arrears, the system provides the following facilities:

  • The mortgage arrears system issues either an initial warning letter, or a default notice followed by a warning letter. This is followed by a Land Registry search before a County Court claim is issued.
  • The system stores details of the mortgage account, a further advance, the current state of the arrears, and a further advance, where appropriate
  • At any time during the course of the litigation procedure, the user can suspend or adjourn proceedings if an arrangement is made with the defendant to increase periodic payments to pay off the arrears, or if the arrears are sufficiently small not to merit further litigation.
  • A Claim for Possession is produced, together with comprehensive particulars of claim. After the claim has been served, and prior to the hearing, a second Land Registry search is conducted, followed by production of a witness statement. If proceedings are reinstated after a previous adjournment, a supplemental witness statement is produced. Different versions of the witness statement can be generated according to the client for whom the user is acting.
  • The system manages the appropriate actions after either a forthwith possession order, suspended possession order on terms, or a suspended possession order for a fixed time is made.  If a Suspended Possession Order on terms is granted, eviction is stayed indefinitely whilst the defendant complies with the order. If the defendant fails to comply with the terms of the Order, the user may decide to enforce it. Having made this decision, the system produces a request for a Warrant of Possession. After the warrant has been served, the defendant may attempt to suspend the eviction. A procedure is provided for managing applications by the defendant to suspend the warrant together with its associated hearing. Comprehensive instructions are provided to agents before attendance at a court hearing.

The rent arrears procedure and the eviction of trespassers provide similar facilities but in a simpler form.
