Silver Link Debt Litigation Software System
The Silver Link Debt Litigation & Recovery software system manages the recovery of debts through the County Court automatically. For money claims it provides the basic process starting with a warning letter prior to commencement of legal proceedings and finishes with any method of enforcing a judgment. Alternatively, bankruptcy or winding up procedures can be initiated. For non money claims, a comprehensive procedure for the recovery of goods is also provided. The system provides the following facilities:
- Consolidation of Debts into a Single Claim - An unlimited number of debts of the same type for a debtor can be consolidated into a single claim.
- Defended Cases - If part admission or full defence is filed, the system provides a defence monitoring procedure with the relevant track allocation forms, applications for summary judgment and stays.
- Standard Particulars - A wide range of standard particulars of claim are provided for both money and recovery of goods claims. Particulars for various forms of purchased debt and local authority matters are also available.
- User Definition of Debt Types - The user may also define particulars of claim for additional debt types using the easy to use procedure definition facilities.
- Interest - The system calculates interest up to (and beyond) judgment at the rate that the user chooses for a case. An unlimited number of rate tables can be defined. Interest will be added to the debt balance. The system follows all of the rules for calculating post judgment interest, when this is required.
- Enforcement - After judgment, procedures for all methods of enforcement are available. These include payment by instalments, warrant of execution, writ of FiFa, charging orders, attachment of earnings orders, third party debt orders and orders to obtain information.
- Bankruptcy and Winding Up – A comprehensive bankruptcy and winding up procedure is provided for both the County Court and the High Court.
- Instalment Payments - The user may create a schedule of instalment payments with either weekly, fortnightly, four weekly, monthly, quarterly or unequal instalment frequencies. The system checks that each payment is received on time. If the defendant defaults on a payment, a letter to the defendant will be printed, and the user may choose what further action to take.
- Settlements – Settlements can be agreed at any time and payment may either be by lump sum, or by instalments. Where appropriate, the system produces a consent order. If the debtor reneges, the settlement is withdrawn and the previous litigation procedure continues.
- Debt Ledger - The system maintains a financial ledger for each debt showing all debits and credits. Payments are allocated according to the method selected.
- Client Letters & Emails – At various points in the procedure, the system keeps the client informed on the progress of each matter, either by producing a letter, or by sending an email automatically. (This facility can be disabled if it is not required).
- Flexible Structure - The structure of the system is inherently flexible so that all elements of the procedure and standard documents can be tailored by the user to suit individual requirements. The Silver Link Procedure Definition Manual describes how to define new procedures and make changes to those supplied. High Court steps and documents can be added easily. The system has been built using the eXact Developer. This is a rapid development tool that eliminates the need for detailed programming wherever possible. To the user, this means that new features can be added in a fraction of the time and cost when compared with systems that have been traditionally programmed.
This module can be integrated seamlessly with the Silver Link Collections, Time Recording and Billing modules.
With a single mouse click, each debt can be switched between collections and litigation and vice-versa.
